Welcome to 1nbox (referred to as "1nbox", "inbox", "we", "our", or "us"), a product operated by Kudo Pty Ltd.

These Terms of Service ("Terms") govern your access to and use of the 1nbox platform, including our website, applications, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree, you must not use the Service.

Eligibility

You must be at least 16 years old to use the Service. If you are under 16, you may only use the Service with the permission and supervision of a parent or legal guardian who agrees to be bound by these Terms.

If you are using the Service on behalf of a business, you represent that you have authority to bind that entity to these Terms.

Description of Service

1nbox is a software platform that enables service-based businesses to manage scheduling and allows customers to book appointments.

We act solely as a technology provider.

We:

  • Do not provide the underlying services offered by businesses
  • Do not guarantee service quality
  • Are not responsible for the actions, omissions, or conduct of businesses or customers

Any agreement formed through a booking is strictly between the business and the customer.

Accounts

You may be required to create an account to access certain features.

You agree to:

  • Provide accurate information
  • Maintain the security of your login credentials
  • Promptly notify us of unauthorized use

You are responsible for all activity occurring under your account.

Customers may book as guests where enabled.

Businesses are responsible for the actions of their staff accounts.

Business Responsibilities

Businesses using 1nbox agree to:

  • Provide accurate service descriptions
  • Honour confirmed bookings unless cancelled in accordance with their policies
  • Maintain legally compliant business practices
  • Set clear cancellation windows where applicable

Businesses are solely responsible for disputes with customers.

Payments and Fees

Payments are processed via third-party providers such as Stripe. By using paid features, you also agree to the applicable payment processor's terms.

Fees

We may charge:

  • Subscription fees
  • Transaction fees
  • Usage-based fees (e.g., SMS packages, additional staff)

All fees are non-refundable unless required by law.

We reserve the right to modify pricing with reasonable notice.

Failed Payments

If payment fails, we may retry charges for up to 14 days. If payment remains outstanding, we may suspend or terminate access to paid features.

Cancellations and No-Shows

Cancellation policies are set by the business.

1nbox is not liable for:

  • Customer no-shows
  • Business cancellations
  • Service dissatisfaction
  • Refund disputes

We do not mediate disputes unless required by law.

Data Ownership and Usage

Business Data

Businesses retain ownership of their data, including customer information.

Platform Rights

You grant us the right to host, process, transmit, and analyze data as necessary to operate and improve the Service.

We may use aggregated and anonymized data for analytics, security, and product development.

We do not sell personally identifiable information.

Acceptable Use

You agree not to use the Service for:

  • Illegal activities
  • Spam or fraudulent bookings
  • Attempting to bypass platform fees
  • Interfering with platform security
  • Offering services that violate applicable laws

We reserve the right to remove content or suspend accounts that pose legal, operational, or reputational risk.

Intellectual Property

The Service, including all software, branding, and content, is owned by Kudo Pty Ltd and protected by intellectual property laws.

We grant you a limited, non-transferable license to use the Service.

You retain ownership of content you upload.

You grant us permission to use your business name and logo for reasonable promotional purposes unless you request otherwise in writing.

Service Availability

The Service is provided "as is" and "as available."

We do not guarantee:

  • Uninterrupted access
  • Error-free operation
  • Compatibility with all devices
  • That the Service will meet every business requirement

We may modify, remove, or discontinue features at any time.

Security and Suspension

We may suspend or restrict access immediately if we reasonably believe:

  • The Service is being misused
  • Security is at risk
  • Fraud is suspected
  • Continued access could expose us or others to legal liability

Termination

You may stop using the Service at any time.

We may terminate or suspend accounts:

  • For breach of these Terms
  • Non-payment
  • Legal risk
  • Fraud or abuse

In severe cases, termination may occur without prior notice.

Limitation of Liability

To the maximum extent permitted by law:

Kudo Pty Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.

Our total liability arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

Indemnification

You agree to indemnify and hold harmless Kudo Pty Ltd from any claims, damages, losses, or expenses arising from:

  • Your misuse of the Service
  • Your violation of these Terms
  • Disputes between businesses and customers
  • Your violation of applicable laws

Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including:

  • Infrastructure failures
  • Natural disasters
  • Government actions
  • Cyber incidents
  • Third-party outages

Modifications to the Service or Terms

We may update the Service or these Terms from time to time.

Material changes will be communicated through reasonable means (e.g., platform notice or email).

Continued use of the Service constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Australia.

Before initiating formal proceedings, parties agree to attempt resolution through:

  2. Mediation
  3. Binding arbitration

Users accessing the Service from outside Australia do so at their own initiative and are responsible for compliance with local laws.
